  • New State Regulations Regarding HOAs

    Starting in January, 2006, the State of Colorado requires Sellers to provide Buyers with Declarations, Covenants, Bi-Laws, Rules and Regulations. The Buyer must acknowledge receipt of all these documents as a stipulation of a real estate purchase if the home falls within the governance of a Home Owner's Association.

    What does all this mean?

    Although the ramifications of defying an HOA have always been in place, legislators have given the HOA "teeth" to pursue those homeowners that do not follow the rules.
    As a Buyer, be sure you receive all the above mentioned HOA documents. Ask the Seller to provide all financial statements and balance sheet to include actual costs, income, all commitments, existing liens, expenses of the HOA, and Architectural Standards. Ask the Seller to disclose any class action or legal actions also.

    Most of the time the Seller and the HOA will be forthcoming and honest about issues. Beware the Seller that does not provide you all this information.

    For your own peace of mind, get help. Margaret and your legal counsel will investigate the history of your favorite property.
